1. Overview

    This Refund Policy applies to all subscription services provided by DenefitsApp, a product of Denefits LLC, registered in British Columbia, Canada (Registration No. LLC0001538).

    By subscribing to our Service, you agree to this Refund Policy alongside our Terms and Conditions and Privacy Policy.

    All payments are processed securely by Stripe. Denefits LLC does not hold or store customer payment details.

2. Subscription Fees

    All subscription fees are billed in advance on a recurring basis (monthly or annually) depending on your selected plan. All fees are stated in Canadian dollars (CAD). Denefits LLC is currently in the process of obtaining GST/HST registration in Canada. Until registration is obtained, no GST/HST will be charged. Once registered, applicable taxes including GST, HST, PST, and QST will be clearly displayed at checkout and on all invoices prior to payment confirmation.

3. Refund Eligibility

    Subscription fees are generally non-refundable except in the following circumstances. Notwithstanding the foregoing, nothing in this policy limits or affects your statutory rights under applicable Canadian federal or provincial consumer protection legislation:

    • Duplicate payments
    • Billing errors made by DenefitsApp
    • Unauthorised transactions (subject to verification and investigation)
    • Cancellation within the statutory cooling-off period (see Section 5)

4. Free Trials

    If a free trial is offered:

    • You will not be charged until the trial period ends
    • To avoid charges, you must cancel your subscription before the trial period expires
    • Cancellations made before the trial ends will not incur any charges

5. Statutory Cooling-Off Period (Canada)

    In accordance with applicable Canadian provincial consumer protection laws, subscribers may cancel their subscription and receive a full refund within the following cooling-off periods:

    • British Columbia: 7 days
    • Ontario: 10 days
    • Quebec: 10 days
    • Alberta: 10 days
    • All other provinces: 7 days

    The cooling-off period begins on the date you receive a copy of this Agreement or the date the Service is made available to you, whichever is later. During the cooling-off period, if you cancel your subscription, you are entitled to a full refund of any amounts paid, regardless of whether you have used the Service, in accordance with applicable provincial consumer protection legislation.

    To exercise your cooling-off right:

    • Email us at support@denefitsapp.ca
    • Include your account email and reason for cancellation
    • Refunds are processed in accordance with the British Columbia Business Practices and Consumer Protection Act. Customers are entitled to request a refund within 15 days of purchase if the service has not been used. Refunds are processed through Stripe Payments Canada, Ltd. back to your original payment method. Processing times may vary between 5–10 business days depending on your financial institution after Stripe initiates the refund.

6. Cancellation Policy

    You may cancel your subscription at any time by:

    • Logging into your DenefitsApp account and cancelling through your dashboard
    • Contacting us at support@denefitsapp.ca

    Upon cancellation:

    • Your subscription will remain active until the end of the current billing cycle
    • No further charges will be applied after cancellation
    • No refunds will be issued for unused portions of the current billing period
    • Your data will be available for 90 days after cancellation as per our Terms and Conditions

7. How to Request a Refund

    To request a refund, follow these steps:

    Step 1: Email support@denefitsapp.ca with:

    • Your full name
    • Account email address
    • Date of charge
    • Amount charged
    • Reason for refund request

    Step 2: Our team will review your request within 3-5 business days. For requests made under a statutory cooling-off period, we will process your refund within 15 days as required by applicable Canadian provincial law, regardless of the outcome of any internal review.

    Step 3: If approved, refunds will be processed within 15 business days to your original payment method

    Step 4: You will receive a confirmation email once the refund is processed

    Note: Refund processing times may vary depending on Stripe's processing timelines and your financial institution. Typically 5-10 business days after approval.

8. Exceptional Circumstances

    Refund requests outside the above conditions may be considered on a case-by-case basis at DenefitsApp's reasonable discretion. To submit an exceptional circumstances request, contact support@denefitsapp.ca with full details of your situation.

9. Non-Refundable Items

    The following are not eligible for refunds:

    • Setup fees or onboarding fees
    • Professional services already delivered
    • Partially used billing periods
    • Add-on services already consumed
    • Transactions older than 90 days

    Please note that statutory cooling-off period rights under applicable Canadian provincial consumer protection legislation override the non-refundable items listed above where applicable.

10. Chargebacks

    If you initiate a chargeback through your bank or credit card provider without first contacting us, and where such chargeback is not related to an unauthorized transaction or a statutory right under Canadian consumer protection law, we reserve the right to:

    • Suspend or terminate your account
    • Dispute the chargeback with supporting documentation
    • Charge an administrative fee per chargeback occurrence

11. Statutory Rights

    Nothing in this Refund Policy affects your statutory rights under applicable Canadian federal or provincial consumer protection legislation, including but not limited to:

    • Consumer Protection Act (Ontario)
    • Business Practices and Consumer Protection Act (British Columbia)
    • Consumer Protection Act (Quebec)
    • Fair Trading Act (Alberta)
    • Consumer Protection and Business Practices Act (Saskatchewan)
    • Consumer Protection Act (Manitoba)
    • Consumer Product Safety Act (Canada)

    For Stripe-related payment disputes, subscribers may also have rights under Stripe's own dispute resolution process available at https://stripe.com/legal/connect-account

12. Changes to This Policy

    We reserve the right to update this Refund Policy at any time. Material changes will be communicated to subscribers by email or through a notice on our website at least 30 days before taking effect.
